MODPADZ – WARRANTY, DAMAGES, AND CLAIMS POLICY

1. General Policy

By purchasing, distributing, or reselling any Modpadz product, the customer or distributor acknowledges and agrees to the following Terms and Conditions governing warranty, damages, claims, and post-delivery service. These terms apply to all Modpadz modular, prefabricated, and container-based units.

2. Warranty and Claim Eligibility

Modpadz provides a limited warranty covering manufacturing defects and damages occurring prior to shipment from the factory.
To maintain eligibility, all customers must strictly follow the official Modpadz Claims Process.

3. Claims Process

To initiate a warranty or damage claim, customers must file a formal report by emailing claims@modpadz.com with in 30 days and include:

• A detailed description of the defect or damage

• Clear photos, videos, and supporting documentation showing the issue

• Order number, delivery date, and proof of purchase

Claims lacking sufficient proof cannot be processed.

4. Damage Responsibility by Stage

Damages are categorized by their point of occurrence:

• a. Factory Defects:
  Modpadz assumes responsibility for verified defects occurring during manufacturing. Approved claims will be resolved by providing replacement parts from the factory. This is handled case by case.

• b. In-Transit Damages (Overseas Shipping):
  Damages sustained during overseas shipment are handled by the shipping vessel or freight carrier under their insurance terms. Customers must provide all documentation and proof required by the carrier’s claims department.

• c. Delivery Damages (Domestic Trucking):
  Any damage occurring during domestic ground delivery shall be addressed by the trucking company responsible for transport. Modpadz will assist by providing necessary documentation.

• d. Unloading Damages (On-Site):
  Damages caused during unloading or crane operations are the sole responsibility of the customer and/or their crane operator. Modpadz does not assume liability for damages during unloading or installation.

5. Compensation and Repairs

Modpadz does not provide monetary compensation or reimbursements for labor, installation, or repair costs, as external labor rates differ from factory conditions.
All repairs or additional modifications performed by the customer are at their own risk and expense.

When applicable, Modpadz may provide replacement parts only, on a case-by-case basis.
All parts will be shipped directly from the overseas factory.
Local replacements or purchases are not eligible for reimbursement or “one-to-one” substitution under warranty.

6. Customer Inspection and Acceptance

Units DO NOT ship until the customer reviews and approves the proof-of-build documentation, which includes photos and videos of the final assembly.
By approving the proof of build, the purchaser acknowledges that the product meets their specifications at the time of shipment.
Post-delivery adjustments, modifications, or dissatisfaction claims will not be eligible for compensation.

7. Distributors and Sellers

All distributors, resellers, and sales partners are considered independent representatives and partners in product development. By agreeing to distribute or sell Modpadz units, distributors accept joint responsibility for assisting Modpadz in managing damages, repairs, and continuous product improvement.

Modpadz will, when necessary, provide replacement parts from the overseas factory. However, no monetary compensation shall be provided for labor, installation, or repair services.
This collaborative partnership is intended to enhance quality and customer satisfaction for future retail customers.

8. Modular and On-Site Assembly Disclaimer

For modular units shipped in panelized or unassembled form, Modpadz does not cover labor, assembly, or installation costs.
This includes, but is not limited to:

• Structural panels

• Staircases and railings

• Balconies and terraces

• HVAC systems

• Fixtures, backsplashes, or other accessories

Damage or wear resulting from transit, offloading, or improper assembly is not covered under warranty.

All purchasers must obtain written approval from Modpadz before performing any repair work, as Modpadz may recommend specific repair methods or alternative solutions.

9. Limitation of Liability

Under no circumstances shall Modpadz be held liable for incidental, consequential, or indirect losses, including loss of use, labor costs, delays, or financial damages resulting from repairs or replacements.

All remedies are limited exclusively to replacement of defective parts, subject to verification and approval by Modpadz.

10. Governing Law

These Terms and Conditions shall be governed and construed under the laws of the State of Texas, USA, without regard to its conflict of law provisions.

Terms and Conditions for Purchasing from Modpadz

Thank you for choosing Modpadz. Please carefully review the following terms and conditions for purchasing our products. By placing an order, you agree to the terms outlined below.

1. No Returns

- All sales are final. Modpadz does not accept returns for any units once the order has been confirmed.

2. Non-Refundable Deposit

- A 50% deposit is required to secure your order. This deposit is non-refundable under any circumstances.

- You may transfer your deposit to another location, but not to a different model. The deposit is used to manufacture your unit with your custom design specifications.

3. Payment Terms

- After your order is complete, you have 30 days to pay the remaining balance in full. Failure to do so will result in the unit not being shipped.

- If payment is delayed, a storage fee of $200 per day may be charged.

4. Order Completion and Delivery

- Once your design is approved and sent for fabrication, no changes can be made.

- Once the order is completed, it cannot be modified in any way.

- Delivery is estimated to occur approximately 4 weeks after the order is completed. However, this may vary depending on shipping lanes, seasons, and other logistical factors.

5. Shipping Policies

6. Warranties

- Warranty terms may vary for each model. Please review the specific warranty for your chosen model prior to purchase.

7. Refund Policy

- No refunds will be issued for any reason. This is a strict policy, and by placing an order, you agree to these terms.
